The division bench that of Justice SC Dharmadhikari and Justice Shalini Phansalkar dismissed petition filed by six medical aspirants who challenged their state government’s interpretation of NEET 2016 Score. This ordinance was signed by the President on May 24, 2016. The State Education Minister, Vinod Tawde also announced that the unaided colleges and deemed universities of the state will not go forward with their own prescheduled entrance tests and must take in account the NEET 2016 score as their admission criteria.

The ordinance also clarified that the state government seats in both government and Government funded institutes only will be exempted from the NEET 2016 Score for this year. These seats will be filled by the CET exams held by the state. The bench however, allowed one of the requests in the petition and invalidated the state government’s decision to add extra five marks for the candidates belonging to the special categories such as Sports Quota, NCC, Defence and so on.

The ordinance amending the Indian Medical Council Act 1956, which governs MBBS and BDS admissions, says that NEET will be universal from 2017-18 for both undergraduate and postgraduate admissions. A year’s relaxation though, is being granted only to state governments in order to address their concerns over variance in CBSE and state board syllabi, and difference in the language in which the central test is held. However, for PG courses, the exam will be held under NEET for 2017-18 session, in December this year.
