CLAT 2017: Upper Age limit restored for admission

As per the latest notification regarding CLAT 2017, on November 10, 2017 the core committee of Common Law Admission Test (CLAT) has released the notification regarding the change in the upper age limit for CLAT 2017.  As per the issued notification, the Bar Council of India (BCI) has revived the rule specifying the maximum age limit for 3 year and 5 year law courses across the country, in harmony with recent court rulings.

Common Law Admission Test (CLAT) is a national level entrance exam conducted every year in the month of May. CLAT 2017 is to be organized by Chankya National Law University, Patna. The exam is conducted for admission in three years B.law degree program and five-year Integrated L.L.B and L.L.M courses in seventeen National Law Universities of India.

The specifications of the notice

The Notification issued by the Bar Council of India(BCI) states that in compliance with the Judgment of the Honourable Supreme Court and the resolution No. BCI: D: 1519 (LE: Cir) – 6 dated 17 September, 2016 of the Core Committee (Bar Council of India) CLAT-2017 has restored the upper age limit for 2017 CLAT Exam as follows: -

The Contender who is considered eligible to appear in CLAT-2017 should be-

  1. Below 20 (Twenty) Years of age as on July 1, 2017, in case he/she belongs to the General/ unreserved category.
  2. Below 22 (Twenty-Two) Years of age as on July 1, 2017 in case he/she belongs to the ST/SC/OBC/ especially Abled Persons (SAP/PWD) categories.

NOTE:  It is clearly mentioned in the notification that CLAT-2017 shall not entertain any new notifications in this regard.

Earlier, there was no upper age limit for admission to the three-year Bachelor’s Law degree course till the academic session 2008-2009. However, an upper age limit of 21 years was authorized for admission to the 5 year integrated (LLB & LLM) degree course. This rule was not applicable to candidates belonging to the reserved categories - SC/ST community.

In the year 2008, the Bar council of India framed the Rules of Legal Education, 2008. The Clause 28 of Schedule III of the 2008 Rules specified the new age limit for admissions to 3 year and 5 year law courses. As per this rule, the upper age limit for admission in 3 year LL.B degree course was specified to be 30 years .However for 5 year integrated (LLB & LLM) degree course the upper age limit was set down 20 years. This rule was accepted by the Supreme Court when the three-member committee submitted its full-fledged report on October 6, 2009, in the support of the Rules of Legal Education, 2008.  The three-member committee was formed by the Supreme Court of India in the Bar Council of India v. Bonnie FOI Law College and others, SLP No. 22337 of 2008.

The clause 28 of Schedule III of the 2008 framed by the 3-member committee was questioned by the newly-elected Bar Council members. The newly elected members appointed S. Prabakaran as a one-man committee without considering the background and history of the 2008 Rules to re-consider/revive the rule for the age restriction clause, declared in the Clause 28.
